Section X - INELIGIBLE UNAUTHORIZED INSURERS
The New York Insurance Law provides that the Superintendent of Financial Services may declare an unauthorized insurer ineligible and order the Association not to stamp insurance documents issued by such unauthorized insurer.
The Association publishes on its website a list of unauthorized insurers which the Association has determined meet the minimum requirements of eligibility in New York.
The list is provided to members to assist in determining companies whose insurance documents the Association will stamp. However, it remains the non delegable duty of the excess line broker to use due care in the selection of any such insurer.
